EZPerDiem, ("Company") reserves the right to update and change these Terms of Service without notice, and you agree to be bound by the future “Terms of Service” changes if and when they are made if you wish to continue using the Service. A violation of the “Terms of Service" may result in termination of your account. This Service may not be used for any illegal purpose. You may not use this Service to help violate any laws in your jurisdiction (including but not limited to plagiarism and copyright laws).
You accept the use of the Service at your sole risk. The Service is provide on an “as is” or “as available” basis. The company does not guarantee uptime or site availability.
The Terms of Service constitutes the entire agreement between you and the Company. The Terms of Service govern your use of the Service and supersede any prior agreements between you and the Company, including but not limited to any prior versions of the Terms of Service.
Any new features or applications related to the Service that are added at future dates are also governed by these Terms of Service. This shall include new releases of tools and resources that do not yet exist.
The Terms of Service shall govern the website, any mobile apps, or any other technology related to the Service.
You agree that everything you have entered in the EZPerDiem website is true and accurate. You agree that you are solely responsible for the accuracy of anything that you enter into EZPerDiem or your final tax return. You understand that EZPerDiem does not verify that the data you enter is accurate in any way. If you have any doubts about the information generated by the EZPerDiem site, it is your responsibility to verify that it is accurate and applies to your situation before you enter it in your tax return.
While EZPerDiem works diligently to ensure the accuracy of all of our data and calculations, errors are always possible, especially when a very large amount of data is used and compiled. Government data is continuously being updated at random intervals, so we do not guarantee that the per diem calculation will exactly match the latest available from the DOT or GSA. Normally such differences in a per diem calculation are very small and negligible. You are encouraged to seek the knowledge of a certified public accountant or professional tax preparer if you have any concerns about the accuracy of the data EZPerDiem provides or if you have any confusion about how to enter the data into an online or off-the-shelf tax software program. EZPerDiem provides some links to appropriate IRS websites so you can personally verify the accuracy of all calculations or unofficial guidance we may provide. All per diem data used can be found by accessing the IRS website. EZPerDiem recommends you save copies of all tax-related information we provide by printing a hardcopy because we do not guarantee that we will save your data. The primary goal of EZPerDiem is to provide a correct flight crew tax return in an expeditious manner. While we strive to find legitimate ways to save tax money for flight crewmembers, EZPerDiem cannot guarantee that the calculations you will receive will save you the most money possible.
EZPerDiem takes reasonable steps to secure your data. The information that EZPerDiem collects is generally not sensitive. No website is 100% secure, and for that reason EZPerDiem does not guarantee that information entered is secure from third-party users. As such, EZPerDiem does not collect information that it considers sensitive unless it is absolutely necessary. If you feel that information you are asked to enter is too sensitive, you should not enter it into the EZPerDiem website. If you are concerned about internet security, you may simply not use the EZPerDiem services.
When creating and maintaining your account, you are required to provide your full legal name, a valid email address, and to be accurate with other required information asked by the Service. A login may only be used by one person, however, a parent may help their children with their logins and accounts as necessary. With this exception noted, a single login may not be shared by multiple people. You may create separate logins for individual people as needed. You must be a human to use the Service. No automated programs or “bots” are permitted to use the Service.
You accept and understand that the Company uses third-party vendors to provide applicable resources, such as hardware, software, networking, storage, and applicable technical services as necessary to run the Service.
You agree to not modify any other website or service in such a way that it falsely implies or misleads other people that it is associated with the Company.
You must not duplicate, reproduce, copy, sell, resell or exploit any part of the Service in any way without the express written permission of the Company.
You must not attempt to modify or hack the Service.
You will keep your contact information accurate and up-to-date.
You will not transfer your account to anyone without first getting our written permission.
You are solely responsible for maintaining the security of your and account and the security of your password(s). The Company is not liable for any loss or damage from your failure to comply with the important security obligation
All content posted to your EZPerDiem account, and by anyone linked to your account, is your responsibility. If there are errors in the content, you alone are solely responsible for such errors (this includes content posted by other people who have their own logins under your account).
When you delete content, you understand that content you shared with others may exist on their accounts or on their computers. You agree that you will not hold the Company responsible for any information or files that you shared.
You understand that some data transmitted on the website may be unencrypted. You understand that content may be transferred unencrypted and involve transmissions over various networks. You understand that content may be transferred unencrypted and involve changes to conform and adapt to technical requirements of connecting networks or devices.
You will not share your password or let anyone else access your account. You will not do anything else that might jeopardize the security of your account.
You will not use a password that you use on other websites or applications that you wish to remain secure.
You are aware of the security risks associated with logging into an account on a publicly used computer or device. If you login to your account on a public computer, you will make sure that your password and other log in credentials are not saved on that computer. You will make sure you log out of the public computer when you are finished with your session.
The Company is not responsible for any lost or stolen credit card or payment information gathered by third parties while making a payment on the Service, even though the Service uses SSL and other security measures to protect your data.
While the Company may elect to enhance its technical support, technical support is only provided as an optional service by the Company, only via email. The Company is not obligated to respond to help requests within any period of time.

You agree and understand that the Company shall not be held responsible or liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to tax audits or improper tax preparation, loss of data or any other intangible losses resulting from: (i) the use or inability to use the Service; (ii) errors on the Service; (iii) incorrect or missing notifications; (iv) or any other matter relating to the Service.
Any failure by the Company to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision.
Your privacy is very important to us. Our Privacy Policy contains important disclosures about how you can use the Service with other accounts and how we collect and can use content you put on the Service.
The Service may currently, or in the future, include features that share assignments or other content that you post with other users. The company is not responsible for information that is shared that users did not want to share with others. You are solely responsible for controlling the sharing permissions with your account, and you accept that the default setting for sharing may be to share information you post with other users that you connect to.
EZPerDiem should not be the sole source of your tax information. It is merely intended to help flight crews calculate the complex tax-related part of their tax returns that relate to their aviation employment. It should not be the sole source of storing important tax-related information.
The Company cannot guarantee that the Service will meet the specific requirements of all users. The Company cannot guarantee that the Service will be uninterrupted, free of error, or secure.
The Company is not responsible should the EZPerDiem.com service become unusable due to server downtime or website malfunctions.
The company will not be held responsible for missing or late tax returns due to errors on the website.
You are expected to report any errors with the service to support@ezperdiem.com.
At any time, the company may modify, add, or discontinue any part of the service. Notice for such changes is not required, and this will not be a reason to refund money.
All prices are subject to change at any time, however, once a paid account is created, those prices will not change in the future.
The company is not liable for modifications to the service, modifications to pricing, suspended accounts, or discontinuation of service.
The Service may be offered with a “free trial” period, during which, you might have access to features that are typically only available to paid members. When the free trial period expires, the features that are reserved for paid members will no longer be accessible until your account is appropriately upgraded.
If an account is upgraded or downgraded, the billed amount will be reflected in the next billing cycle. No prorating for downgraded accounts in the middle of a billing cycle for will occur.
Downgraded accounts may lose access to features that were previously available. The change in the account status will occur at the next billing cycle. If data is lost because of downgraded service, the Company cannot be help liable or responsible for such loss.
You are responsible for any and all taxes, levies, or duties charged by taxing authorities.
All refunds are processed in accordance with our refund policy.
All content on the EZPerDiem site will be inaccessible immediately after a cancellation request is completed. All data from cancelled accounts may be permanently deleted from our servers, including backups and logs, in order to save server space.
The company may terminate or suspend your account or refuse service for all or any account features, including a permanent or temporary ban from the use of the Service, at any time. It is within the Company’s sole discretion to suspend or terminate account access at any time for any reason. The Company also has the right to refuse service to anyone at any time for any reason.
The Company has the right to disable or suspend service if usage significantly exceeds the average or expected usage of the Service, as compared to other users of the Service.
All users who post content on the Service must do so in accordance with U.S. copyright law and also in accordance with the copyright laws of the country you live in.
The service has no intellectual property rights over the material or content you provide to the Service. You are responsible for all such material and all such material that you upload or share is your property.
The Company reserves the right to remove or refuse content being uploaded or shared for any reasons, although the Company does not screen, or have an obligation to screen or pre-screen, any content posted on the Service.

EZPerDiem does not provide physical audit assistance. EZPerDiem will answer any questions a tax auditor may have if you are ever audited via fax, email, or telephone, but no EZPerDiem representative will be present during a tax audit. You are ultimately responsible for understanding and verifying that what you are writing off is allowable. Because every user circumstance is unique, EZPerDiem does not, and cannot, guarantee that every entered expense is deductible. EZPerDiem users should apply rules stated in the tax code to any expenses they are attempting to write off.
EZPerDiem does not prepare taxes. EZPerDiem is only a tool that is used to expedite the tax preparation process. EZPerDiem is first and foremost a per diem calculator and expense tracker intended for use by aviation flight crewmembers. It is simply a tool to be used in adjacent with all of the other tax data available to the general public. EZPerDiem is only a civilian aviation-related website.
Anyone not in the aviation profession will not benefit from the information provided by EZPerDiem. EZPerDiem does not provide official tax advice.
The terms meal expense, standard meal expense, and per diem calculation are used interchangeably throughout this website. Some terms, such as "per diem deduction" are not actual tax nomenclature that will be found in the tax code. These terms are simply used to help users understand the service better.
EZPerDiem gives some unofficial guidance for users of TurboTax and TaxCut tax preparation software. This unofficial guidance is so users can better learn where to insertthe EZPerDiem per diem calculation (standard meal expense) and airline related tax expenses. EZPerDiem is not responsible for mis-entered information into any tax software package, even if it is described within the content of the EZPerDiem site or network of other EZPerDiem sites.
For a pilot or a flight attendant to benefit from deducting meal expenses, that pilot or flight attendant must itemize their deductions on their tax return. If you are a pilot or a flight attendant who takes the standard deduction (does not itemize), the EZPerDiem calculations will not increase your refund. Before you will see an increase in your refund, you must also have enough employee business expenses to exceed the 2% limit as defined by the IRS. Information on the 2% limit is contained in various unofficial places within this website, but can also be accessed via links to the IRS website. You must also include the per diem you were reimbursed from your employer(s). The per diem reimbursement (commonly called nontaxable per diem) is up to you to find in your W-2, last paycheck stub, or other company pay-related documentation. If EZPerDiem provides guidance, it is only to give pilots and flight attendants ideas on what may be a deductible, and that guidance is unofficial. The determination on whether that deduction is legitimate rests with you or your professional tax preparer.
Users not accepting this user agreement may not use the EZPerDiem website.
