What if my company buys meals for me?

If your company buys your meals, that is like getting 100% of your meals provided for you and you cannot take the meal expense calculation. It becomes ambiguous if the company buys some (but not all) of your meals and reimburses you with per diem also. In those cases it becomes somewhat confusing how to handle the reimbursement because some meals are provided to you directly from the company while others are typically tracked via an accountable plan. We are currently seeking an answer to this issue from the IRS.

The one thing that is certain is that you MUST incur meal expenses to take the meal deduction. If the company you work for provides all of your meals, you cannot take the deduction.
